1. Purpose

These General Terms and Conditions of Use and Sale (T&C) define the terms of access, use and sale of the Aria Inspire Service (hereinafter "the Service"), which offers motivational support for smoking cessation.

2. Nature of the Service

The Service offers a chatbot for smoking cessation support. It is a motivational and informational tool, not medical. The Service does not provide any diagnosis, monitoring, prescription, or medical consultation. It does not replace a healthcare professional under any circumstances.

3. Service Access – Free and Paid Version

Access to the Service is offered in freemium mode: most features are accessible for free and without commitment. Some advanced, personalized or value-added features are available as subscriptions or one-time purchases (hereinafter "Paid Services").

4. Account Creation and Terms Acceptance

Registration for the Service, whether free or paid, implies full acceptance of these T&C. The user certifies being of legal age and having legal capacity to contract.

5. Intellectual Property

All content, text, illustrations, logos and trademarks on the Site and Service are the exclusive property of the Publisher or its partners. Any unauthorized reproduction, distribution or use is strictly prohibited.

6. Liability and Limitations

The Publisher declines all liability for use of the Service for purposes other than smoking cessation support. The Service is not intended for minors or persons under medical treatment without prior advice from a healthcare professional. The user is solely responsible for their use of the Service.

7. Personal Data Protection

8. Financial Terms (Paid Services)

The terms, prices and features of Paid Services are detailed on the Site. Payments are made securely by credit card via Stripe. The 14-day withdrawal right does not apply to digital services fully performed before the end of the withdrawal period, subject to the user's prior express consent.

9. Termination and Account Deletion

The user may terminate their account at any time through the dedicated interface or by written request to contact@aria-coach.chat. The Publisher reserves the right to suspend or delete an account in case of non-compliance with these T&C.

10. Changes to Terms

The Publisher reserves the right to modify these T&C at any time. Any modification will be notified on the Site and/or by email. Use of the Service after a modification constitutes acceptance of the new terms.

11. Applicable Law and Disputes

These T&C are subject to French law. In case of dispute, the user may resort to a mediator or refer to the competent court.
