Can my employer sanction my smoke breaks?
Yes, if they exceed what is allowed in internal policy or disrupt the service. But not the fact of smoking itself during an allowed break.
Is a smoking room mandatory in the company?
No. The law does not require providing a smoking room. It allows one under strict conditions (dedicated extractor, isolated room, etc.) — but it is rare in practice.
What about vaping in the office?
In many countries since 2016-2017, vaping is also banned in most shared workplaces. The employer may locally allow it in specific zones. Check your internal policy.
Is workplace passive smoking still an issue?
Much less since 2007-2008 in the EU/UK. It remains in some sectors (HoReCa terraces, outdoor construction, farming). The worker can flag it to occupational health.
Can my employer refuse to hire a smoker?
No, that is discriminatory in France and most EU countries (unlike some US states). They can however offer incentives to quit (in-house programmes, bonuses).
